Here’s something I need to get off my chest.
While I’ve been on my supposed hiatus, lolling about, eating bon bons and sipping sparkling water, there’s been a great deal of Supreme Court discussion to the tune of “look, the court isn’t really so conservative after all, and everything is actually hunky-dory.”
Do not believe the people who say this. They have no idea what they are talking about.
Many of the recent, more progressive decisions are the result of one vote: O’Connor’s. When she retires, as she is expected to do shortly, the jurisprudence could turn on a dime, especially if we end up with another Scalia, Robin–er, I mean, Thomas–or Rehnquist. Even if O’Connor doesn’t retire, the average age of the Justices is 68. The situation, while better than we thought, is still dire.
