A Texas law prohibits recognition of same-sex marriages and civil unions, and the Texas Board of Education has argued that health textbooks failing to define marriage as a union between a man and woman would violate this law.

Eager to avoid offending officials in the state, which is the second-largest purchaser of school textbooks in the nation, publishers of the textbooks have agreed to define marriage as a union between members of the opposite sex.
